The CKM Investment Trust ARSN 090 880 890 is a managed investment scheme registered under the Corporations Act 2001 with CKM (Mortgages) Limited ABN 78 089 263 310 AFSL 238091 as the responsible entity (trustee). Its predecessor, the CKM Investment Unit Trust was established in 1985, acting as a pooled fund for superannuation fund clients of Millar Partners, Chartered Accountants, and later opened to other investors.
In 1999 in view of legislative changes and the substantial size to which the trust had developed, it was decided to meet the necessary criteria and establish the CKM Mortgage Trust as a registered managed investment scheme. All of the interests of members in the CKM Investment Unit Trust were transferred to the new CKM Mortgage Trust.
The CKM Mortgage Trust has:
- a constitution (trust deed) that complies with the legislative requirements and, amongst other things, sets out the responsible entity's duties in relation to unitholders;.
- a comprehensive compliance plan lodged with the Australian Securities and Investments Commission;
- an independent compliance committee that includes two external expert compliance members;
- an independent compliance officer;
- a detailed operations manual;
- a current product disclosure statement;
- a custodian, Australian Executor Trustees (SA) Limited appointed to conduct a regulated banking account.
In addition. CKM (Mortgages) Limited holds an Australian financial services licence number 238091 permitting us to act as the responsible entity of the CKM Mortgage Trust and is subject to the regulatory requirements of that licence. CKM (Mortgages) Limited also holds professional indemnity insurance cover of $5m.
ASIC requires that we appoint a panel of valuers and all valuations must be under instructions given by CKM (Mortgages) Limited or by solicitors acting on its behalf . We do not accept valuations instructed from borrowers. ASIC also requires that valuers, where possible, are registered under a State or Territory valuer registration scheme and include a statement in their valuation report on whether the valuation complies with all relevant industry standards and codes. We also require valuers to hold appropriate professional indemnity insurance.
The directors of CKM (Mortgages) Limited are partners of the firm of Millar Partners, Chartered Accountants. Millar Partners receive fees from the Trust for services provided to the Trust. Legal work in respect of mortgage matters is outsourced to one of our panel of solicitors.
